Mistrial declared in forced cell phone swallowing case

From Digg, “A judge declared a mistrial Friday after a jury said it was unable to reach a verdict in the case of a man accused of shoving a cell phone down his former girlfriend’s throat.

Marlon Brando Gill, 24, had been charged with first-degree assault for allegedly forcing the cell phone into the mouth of Melinda Abell, 25, on Dec. 23.”

I can understand why this trial ended up in a mistrial. The boyfriend says that the girlfriend, in order to hide who she was talking to on the cell phone, swallowed the cell phone. The girlfriend says that she was too drunk to remember how the cell phone got in her throat. She counters that if she wanted to prevent her boyfriend at looking at the cell phone she would have broken it or thrown it out the window.
